1. Introduction
These Terms of Service (the "Terms") govern your use of Tatany, the AI tattoo generator offered at tatany.app (the "Service"). Using or accessing the Service means you accept these Terms; if you do not accept them, please do not use the Service.
2. Service Description
The Service lets you create tattoo concepts from text, redraw uploaded sketches and photos with image-to-image models, mock up placement on photos, and generate written tattoo concepts. Certain features need an account, a subscription, credits or a payment.
Tatany is an independent product built on third-party infrastructure and AI model providers. According to the model you select, requests may be handled by OpenAI GPT Image models, Google Nano Banana (Gemini) image models, or DeepSeek language models for written tattoo ideas. The list of models, their names, abilities and providers can change. We are not affiliated with or endorsed by these providers unless we explicitly say otherwise.
Generated images can be inaccurate, incomplete or unexpected, and may resemble content created for someone else. A generated design is a concept, not a stencil and not professional tattoo or medical advice; you are responsible for reviewing it, and having a qualified tattoo artist assess it, before relying on it, inking it, publishing it or sharing it.
3. Eligibility and Accounts
- Only people who can legally enter a contract may sign up. Signing up on behalf of a studio or company means you are authorized to commit it to these Terms.
- Keep your account and billing details accurate and up to date.
- Protect your login credentials; you are responsible for what happens under your account.
- Tell us quickly at support@tatany.app if you think someone else has accessed your account.
4. User Content and Intellectual Property
We claim no ownership of your tattoo prompts, reference uploads or the designs you generate; any rights you lawfully have in them remain yours.
Designs created on a paid plan or with purchased credits may be used commercially, for example as flash, merchandise or drafts for clients. Designs created on a free account are for personal, non-commercial use, and their downloads carry a small watermark. It is your responsibility to make sure your inputs, and the way you use outputs, respect the law and do not violate anyone's intellectual property, privacy, publicity or other rights—for example by uploading another artist's work or someone else's photo without permission.
To render, store and show your tattoo work back to you, Tatany and the vendors it relies on need a narrow, non-exclusive permission to store, duplicate, send, process and display your inputs and outputs. That permission covers operating, protecting, debugging and supporting the Service and nothing more. This license does not transfer ownership of your lawful content to us.
The Service itself—its software, interface, branding, documentation and original site content—belongs to Tatany or its licensors. Except as the law allows or with our written permission, you may not copy, resell, reverse engineer, scrape or commercially exploit it.
5. Subscriptions, Credits, Billing, and Cancellation
- Billing authorization: When you buy a subscription or credits, you authorize the payment provider displayed at checkout to charge the amount shown, applicable taxes and any recurring fees disclosed to you.
- Automatic renewal: Recurring subscriptions renew at the end of each billing period until you cancel. You see the billing interval and price before you pay.
- Cancellation: Cancel through the subscription management portal or the cancellation option in the pricing or account area. Cancelling ends future renewals and usually takes effect when the current paid period finishes.
- Credits: The credit cost of a generation depends on the model or workflow chosen. Credits stay with the account that bought them, cannot be moved to another user, and expire on the schedule shown on the pricing or checkout page.
- Payment processing: Waffo Pancake or another payment provider named at checkout may process your payment. Full card details are handled by that processor and are not stored on our servers.
- Refunds: Our Refund Policy sets out who is eligible and how to ask. These Terms do not restrict mandatory consumer rights.
If a charge looks wrong, please contact support@tatany.app so we can look into it before you open a payment dispute.
6. Acceptable Use Policy
The rules below form our Acceptable Use Policy. They apply to everything you type, upload or generate on Tatany, and to any attempt to bypass the platform's limits.
Tatany may not be used to make, alter, submit, ask for, distribute or assist with any of the following:
- Sexual or NSFW content: Porn, nude imagery, explicit or sexually suggestive designs, fetish material or the advertising of sexual services. Child sexual abuse material (CSAM), sexualized images of minors, and grooming or exploitation of minors are strictly forbidden and handled with zero tolerance.
- Violent or graphic content: Graphic injury, gore, torture, praise of violence, terrorism or violent extremism, instructions for weapons of mass destruction, or material meant to threaten or enable physical harm.
- Hateful or abusive content: Material that attacks, dehumanizes or harasses people, or promotes discrimination or violence against them, because of protected characteristics—including hate symbols intended as tattoo designs.
- Deceptive impersonation or deepfakes: Non-consensual intimate imagery, misleading depictions of real people, impersonation, identity fraud, or deepfakes designed to deceive viewers about where they came from or whether they are real.
- Intellectual-property or privacy violations: Content that infringes copyright, trademarks, publicity or privacy rights, confidential information or other proprietary or personal rights, such as copying a living artist's signature design.
- Illegal, fraudulent, or harmful activity: Content that breaks the law, supports scams or phishing, spreads malware, encourages regulated wrongdoing, exploits vulnerable people, or aims to deceive or cause harm.
You also must not evade safety filters, test or disrupt platform security, automate unauthorized access, scrape outputs in bulk, resell access without our consent, or use the Service in breach of applicable law or card-network rules.
7. Content Review, Reporting, and Enforcement
Prompts, uploaded reference images and generated outputs are checked by automated safeguards, which may include blocklists, content-safety filters and safety controls supplied by our AI providers. Because automated checks can miss things or make mistakes, flagged or reported content may also be reviewed further.
To report prohibited content, impersonation, a child-safety concern or infringement, email support@tatany.app with the subject Content Report. Add the relevant URL or account details, describe the problem and attach screenshots or other evidence if you can. Expect a first reply inside three business days; anything involving child safety or a credible threat of physical harm jumps the queue.
Based on how serious the issue is, the account's history and the applicable law, we may decline a request, block or remove content, restrict features, suspend or close an account, keep relevant records, or refer suspected illegal activity to the authorities. Severe violations involving child exploitation, terrorism, credible threats, fraud or non-consensual intimate imagery can lead to immediate suspension. You can appeal an enforcement decision by replying to the notice or writing to support with the relevant context.
8. Privacy
What personal data we gather, why, how long we keep it and who receives it is covered in the Privacy Policy. By using the Service you understand that prompts, uploads and related request data may be passed to infrastructure, storage, safety and AI model providers as needed to run the workflow you chose.
9. Service Availability and Changes
We provide the Service "as is" and "as available". Models, features, credit prices, limits and availability can change, and we may modify, pause or end parts of the Service to keep it secure, reliable, compatible with providers or legally compliant. No guarantee is given that the generator will always be online or will produce a specific design.
10. Disclaimer of Warranties
As far as the law permits, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement and the accuracy of AI outputs. Outputs are not legal, medical, financial or other professional advice, and they are not a substitute for a tattoo artist's judgement about your skin.
11. Limitation of Liability
As far as the law permits, Tatany and its affiliates, service providers and staff are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or business opportunities arising from the Service, including any decision to get a tattoo based on a generated design. Rights and liabilities that cannot lawfully be excluded are not affected.
12. Suspension and Termination
You can stop using the Service whenever you like. Where we have reasonable grounds to see an account as a fraud, abuse, security, legal, payment or policy concern, we can restrict, pause or terminate it. Requests to close an account or delete personal data follow the process in the Privacy Policy.
13. Changes to These Terms
These Terms may change as the Service, our providers or legal requirements evolve. We will publish the revised Terms here and update the date at the top, and where the law requires it we will give additional notice of material changes. Continuing to use Tatany once an updated version is in force counts as agreeing to it.
14. Governing Law
These Terms are governed by the laws of the place where the operator of the Service is established, without removing any mandatory consumer protections that apply to you. Please contact us first so we can try to settle any issue informally before formal proceedings begin.
